[ARCHIVED] City of Troy Responds to Reports That Harbour Point Gardens Residents May Move Back Monday, June 26

TROY, N.Y. – The City of Troy has received reports that Harbour Point Gardens residents are being told that they may move back in on Monday, June 26. The City of Troy has not received a request to have the units inspected, and apartments may not be reoccupied until violations are corrected and an inspection has been made by the Bureau of Code Enforcement to verify that the violations are satisfactorily corrected.

“I am seriously concerned by the fact that 182 Delaware LLC is reportedly telling tenants they may move back into these unsafe apartments on Monday, and that they have not put up the necessary safety fencing we ordered,” said Troy Mayor Wm. Patrick Madden. “Our residents deserve clear and honest communication and, to ensure they have the facts, we have requested contact information for each resident impacted by the evacuation, but to date, 182 Delaware LLC has not provided it.”

The City of Troy encourages the property owners to work collaboratively with the City to ensure the residents can safely return as soon as possible. Troy Mayor Wm. Patrick Madden and the City of Troy have released a structural engineering report prepared for the city by independent engineering firm, LaBella Associates. The report substantiates the grave concerns about the safety and habitability of apartment units at Harbour Point Gardens apartments. The report, complete with photos and laser measurements, may be viewed in its entirety here.

Among a number of items, the independent engineer found that exterior walls contained holes and joints between the building envelope and perimeter of windows are not maintained, weather resistant, or water tight.

Background:

On June 22, 2023, exterior brick veneer deficiencies were observed by a structural engineer contracted by The City of Troy. 58 units at 16 addresses in the apartment complex were posted unfit for human habitation. 182 Delaware, LLC was instructed to remove the dangerous materials per structural engineers' recommendations immediately (per Troy City Ordinances 176-17 and/or 141-18.) Once dangerous materials are removed and Code Enforcement or a licensed and qualified structural engineer can verify there are no structural deficiencies, tenants can return to their apartments. To date, 182 Delaware LLC have not released a structural engineering report nor have they filed for an inspection from Troy Code Enforcement.

The Madden Administration believes everyone deserves safe housing—in fact, our laws demand the safety of rental units—which is why the City of Troy acted so quickly to evacuate neighbors when these unsafe conditions were confirmed.
