[ARCHIVED] Troy Deputy Mayor Meets with 182 Delaware, LLC's Representation

TROY, N.Y. – Legal representatives from 182 Delaware, LLC sat down with Deputy Mayor Christopher Nolin and city officials. Troy leadership laid out the steps towards remediation (which had been previously outlined in the structural engineering report provided to them late last week).

"Many folks are asking when they will be able to move back home, and while the City is working as hard as it can, it is impossible to forecast when residents may return to their homes without a structural engineering report or a plan for remediation from 182 Delaware, LLC," said Troy Deputy Director of Public Information, Frank Sainato. "Our goal is for residents to return to their homes as soon as possible but their safety is our number one priority."


A link to a reel of b-roll footage shows Code Enforcement and Troy city officials at work on Thursday morning: knocking on doors, talking to residents and posting notices. One of the LaBella Associates engineers is the woman wearing neon yellow. If used, the footage may be attributed to the City of Troy.

The City of Troy is encouraging the property owners to work collaboratively with the City to ensure the residents can safely return as soon as possible. Troy Mayor Wm. Patrick Madden and the City of Troy released the structural engineering report prepared for the city by an independent engineering firm, LaBella Associates. The report substantiates grave concerns about the safety and habitability of apartment units at Harbour Point Gardens apartments. The report, complete with photos and laser measurements, may be viewed in its entirety here.

Among a number of items, the independent engineer found that exterior walls contained holes, and that joints between the building envelope and the perimeter of the windows are not maintained, weather resistant, or water tight.

Background:
On June 22, 2023, exterior brick veneer deficiencies were observed by a structural engineer contracted by the City of Troy. 58 units at 16 addresses in the apartment complex were posted unfit for human habitation. 182 Delaware, LLC was instructed to remove the dangerous materials per the structural engineers' recommendations immediately (citing Troy City Ordinances 176-17 and/or 141-18.) Once dangerous materials are removed and Code Enforcement or a licensed and qualified structural engineer can verify there are no structural deficiencies, tenants can return to their apartments. To date, 182 Delaware, LLC have not released a structural engineering report nor have they filed for an inspection from Troy Code Enforcement.

The Madden Administration believes everyone deserves safe housing—in fact, our laws demand the safety of rental units—which is why the City of Troy acted so quickly to evacuate neighbors when these unsafe conditions were confirmed.
